Deflexional License Manager

Welcome to the Deflexional License Manager, a service provided by Deflexional AB. By using our service to create license keys for your COMSOL Apps, you agree to the following terms:

1. Service Overview

The Deflexional License Manager enables users to create license keys for specific COMSOL Apps. Each license key is generated based on a secret key known only to the user.

2. User Responsibilities

Users are responsible for maintaining the confidentiality of their secret key. Deflexional AB disclaims any liability for losses or damages incurred as a result of the user's failure to maintain the confidentiality of their secret key. If a license key becomes publicly available online, the user assumes full responsibility for any consequences that arise from such exposure. Deflexional AB bears no responsibility for the misuse or unauthorized distribution of license keys.

3. Ownership Rights

Deflexional AB retains all rights and know-how related to the creation of license keys. Users own the rights to all license keys they have created using the Deflexional License Manager. However, users do not gain any rights to the underlying technology or processes used to generate the keys.

4. Limitation of Liability

In no event shall Deflexional AB be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with the use of the Deflexional License Manager. Deflexional AB’s total liability, if any, shall be limited to the amount paid by the user for the service, if applicable.

5. Disclaimer of Warranties

The Deflexional License Manager is provided "as is," without warranties of any kind, either express or implied. Deflexional AB disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

6. Data Backup and Availability

Users are responsible for regularly backing up their license key data. While Deflexional AB makes reasonable efforts to ensure the availability of user data, the company does not guarantee the integrity or availability of data at all times. Users are solely responsible for maintaining their own backups. In the event of bankruptcy or service discontinuation, Deflexional AB will make all user data, including license keys, available for download. Users can access and download their data at any time.

7. Bankruptcy Clause

In the unlikely event of bankruptcy, the source code related to the Deflexional License Manager will be made available to users. This ensures that users can continue to manage their license keys independently. Users will retain the ability to download their license keys and related data at any time during the use of the service.

8. Dispute Resolution and Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms of Use shall be resolved through mandatory arbitration in Stockholm, Sweden, under the rules of the Arbitration Institute of the Stockholm Chamber of Commerce. In the event arbitration is not possible, Swedish courts shall have exclusive jurisdiction.

9. Modifications to Terms

Deflexional AB reserves the right to modify these Terms of Use at any time. Users will be notified of any changes via email. Continued use of the Deflexional License Manager after receiving an email notification of changes constitutes acceptance of the updated terms. If you do not agree to the updated Terms of Use, you must discontinue using the Deflexional License Manager within 30 days of receiving the notification of change.

10. Consent to Electronic Communications

By using the Deflexional License Manager, you consent to receive communications from Deflexional AB electronically. These communications include updates to the Terms of Use, notifications regarding your account, and other information pertinent to the use of the service.

11. Termination of Service

Deflexional AB reserves the right to terminate or suspend access to the Deflexional License Manager for any user at any time, for any reason, including violations of these Terms of Use. Users may terminate their use of the service at any time by ceasing all access to the Deflexional License Manager.

12. Severability

If any provision of these Terms of Use is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.
